FCC could soon ban DJI drones already approved and sold in America

The DJI Mini 5 Pro isn’t a military drone. And the Air 3S certainly isn’t something most people would associate with the battlefield. Yet these, and several other popular DJI drone models, could potentially get caught in the Federal Communications Commission’s latest drone crackdown.

The reason? LiDAR.

The FCC is considering restrictions on previously authorized foreign-made drones with technologies including LiDAR, thermal imaging, and aerosol-dispensing capabilities. That could mean popular consumer drones such as the Mini 5 Pro and Air 3S could eventually disappear from US shelves — not because they are military aircraft, but because they contain technology the FCC has placed inside its proposed definition of “military-grade.”

This proposal is particularly significant because the FCC isn’t just talking about future drones. It is considering restrictions on foreign-made drones that were already authorized for the US market and are being sold today.

That means a drone you can legally buy right now could potentially become a drone you can no longer buy tomorrow.

The ‘military-grade’ label is broader than it sounds

The FCC’s proposal, published in the Federal Register on August 3, seeks comment on whether to prohibit the continued importation and marketing of previously authorized foreign-produced drones that fall into categories the agency considers military-grade or particularly risky to national security. Comments can be submitted until September 2.

At first glance, “military-grade” sounds like a category most recreational pilots can ignore. But look at what the FCC actually proposes to include.

The list covers drones with thermal imaging, LiDAR sensing, aerosol-dispensing capabilities, docking stations, swarming capabilities, defense-payload integration, and a takeoff weight of 55 pounds or more.

Those capabilities aren’t limited to military aircraft. Thermal cameras are routinely used by search-and-rescue teams. LiDAR can be used for obstacle avoidance and navigation. Agricultural drones spray crops. Docking stations support automated public safety and inspection missions. Large drones can carry supplies into areas that are difficult or dangerous to reach.

And LiDAR is now showing up in consumer drones. The DJI Air 3S and Mini 5 Pro, for example, use LiDAR as part of their obstacle-sensing system. But these are not obscure enterprise aircraft. They’re drones ordinary Americans can recognize. That’s why the FCC’s proposal has suddenly become a much bigger deal for the consumer market than the phrase “military-grade” might suggest.

This could affect drones already approved for sale

This is the detail that deserves the most attention. Back in December 2025, the FCC added foreign-produced drones and critical components to its Covered List following a national security determination. That move stopped new drone models from receiving FCC authorization. But products that had already received authorization could continue to be imported and sold. The latest proposal would change that.

The FCC says it is considering prohibiting the continued importation and marketing of previously authorized covered military-grade UAS and UAS critical components. In other words, this isn’t simply a case of DJI launching a new drone, like the budget-friendly Lito series, and discovering that it can’t get FCC approval.

Soon, a product could already be approved, already be on store shelves and already be in the hands of thousands of American customers, and still potentially be caught by the new restrictions.

If adopted, the FCC proposes giving affected parties 180 days after publication of the final rule to stop importing and marketing the covered equipment.

That’s why the proposal has been described as effectively retroactive. It wouldn’t erase the FCC authorization from history. It would restrict what manufacturers and sellers can do with products that already received that authorization.

Now, if you already own a Mini 5 Pro or Air 3S, the proposal isn’t telling you to stop flying it. The FCC specifically says the proposed prohibition would not apply to the use or operation of drones that have already been purchased. So, this isn’t a situation where the government would suddenly make your existing drone illegal to operate. The problem comes later.

If the restrictions are adopted, the same model could become unavailable for new US purchases. Replacement components covered by the rules could also become more difficult to obtain, creating another headache for operators who depend on these systems for years rather than months. That’s a very different proposition from simply preventing a new generation of drones from entering the market.

LiDAR isn’t exactly a military feature

DJI’s argument is straightforward: the company doesn’t make military drones, and technologies such as LiDAR aren’t inherently military. That’s particularly relevant to consumer drones.

On drones such as the Mini 5 Pro and Air 3S, LiDAR is part of the aircraft’s obstacle-sensing and nighttime safety system. In extremely dark conditions where the ambient light is less than 1 lux, the vision sensing system on normal drones can become ineffective, but Mini 5 Pro’s forward-facing LiDAR can still provide obstacle sensing for the drone. Similarily, during nighttime return-to-home operations, the drone can use the forward-facing LiDAR to sense forward obstacles and navigate upwards to avoid them, making the return flight safer.

LiDAR absolutely has military applications. It can be used for mapping, navigation, and reconnaissance. But so can cameras, GPS, thermal sensors and communications equipment.

The question the FCC is now asking is whether the presence of these capabilities is enough to classify an otherwise civilian drone as “military-grade.” The Commission is actually asking commenters to weigh in on that very issue, including whether some of the proposed categories sweep in drones that aren’t military-grade.

That’s an important distinction. The FCC hasn’t finalized this definition. It is asking Americans whether it should use it.

Farmers could be caught too

The LiDAR issue may be the part that grabs consumer attention, but another category could have much bigger consequences for American agriculture.

The FCC’s proposal covers foreign-made drones capable of dispensing what it calls “economic poison” under FAA rules. That is essentially regulatory language for drones capable of applying certain pesticides and other agricultural chemicals. In other words: agricultural spraying drones.

For a farmer, this isn’t a military capability. It’s a piece of precision-agriculture equipment. Agricultural drones can be used to apply treatments to crops without sending tractors through fields, potentially reducing water and chemical use while lowering operating costs.

DJI says American farmers could face significantly higher costs if they lose access to these systems, particularly where comparable domestic alternatives aren’t readily available.

The broader point is that the FCC’s category is based on what a drone is capable of doing, rather than necessarily how an individual operator actually uses it. And that’s where the proposal gets uncomfortable. A capability that could theoretically be useful in a military context can also be incredibly useful on a farm.

Public safety isn’t safely outside the proposal either

The same problem applies to thermal imaging. Search-and-rescue teams use thermal-equipped drones, such as the DJI Matrice 4TD, to find missing people, particularly at night or in difficult terrain. Fire departments and other emergency responders can use thermal cameras to locate people and identify hotspots when conditions make it dangerous or impossible for crews to see clearly.

The FCC’s proposal, however, specifically identifies thermal imaging as one of the technologies that could qualify a foreign-made drone for the proposed restrictions. That means a technology that can be described as a military sensor can also be a life-saving public safety tool. And American agencies have spent years building drone programs around exactly these kinds of capabilities.

For those agencies, replacing an established fleet isn’t as simple as ordering another drone online. It can mean retraining pilots, replacing batteries and payloads, rebuilding software workflows and potentially spending substantially more on equipment.

Then there are DJI Docks and FlyCart

The proposal doesn’t stop with aircraft. The FCC also specifically lists drone docking stations.

DJI Docks have become a major part of automated drone operations, allowing organizations to deploy drones remotely for recurring inspections, public safety missions, and other applications. Under the FCC’s proposed categories, the dock itself could potentially become a covered product.

Then there’s the 55-pound threshold. DJI’s FlyCart delivery platforms fall into the larger-drone category and are designed to transport heavy loads in difficult environments. Large cargo drones have also demonstrated their value in disaster response and humanitarian missions, where conventional transportation can be disrupted.

Again, the technology can have obvious dual-use potential. But that doesn’t automatically make every civilian use a military application. That’s the tension running through the FCC’s proposal.

It would be easy to look at all of this as another fight between the FCC and DJI. But the implications are broader. The FCC’s proposal applies to categories of foreign-produced drones and components, not simply one company. If the definition is broad enough to cover consumer LiDAR drones, agricultural aircraft, thermal public safety platforms and docking systems, operators using products from multiple manufacturers could potentially be affected.

It also raises a bigger question about what happens to products that have already cleared the government’s authorization process. A drone manufacturer and its customers can reasonably assume that an approved product can remain on the market, subject to the rules in effect at the time. This proposal challenges that assumption.

The clock is ticking

The FCC is accepting public comments until September 2, 2026.

And the agency is explicitly asking questions that matter to ordinary drone users: Are the proposed categories too broad? Are there comparable US-made alternatives? What would restrictions mean for consumers and businesses? Would the restrictions be cost-effective and in the public interest?

You don’t have to be a defense contractor to have a stake in those answers. If you fly a DJI Mini 5 Pro for fun, use a DJI Air 3S for your business, operate a thermal drone for search and rescue, use an agricultural drone on a farm or run an automated docking system, this proposal potentially matters to you.

DJI is urging affected users to submit comments explaining how they use their drones, which capabilities they rely on, how restrictions would affect them, and whether affordable alternatives actually exist.

The FCC hasn’t banned these drones. But it is considering a policy that could make some of the drones Americans are buying today unavailable tomorrow. And that makes the phrase “military-grade” worth looking at a lot more closely than it initially seemed.
